In the present document of the International Commission of Jurists (ICJ), the ICJ presents its submission to the Universal Periodic Review (UPR) of Spain. In this review, the Working Group on the UPR and the Human Rights Council should address the practice of incommunicado detention, and the transfer of persons as part of the alleged cooperation of Spain in the US-led renditions programme. The ICJ also draws attention to the threat to judicial independence posed by the recent. The ICJ states that the principle of immediate access to a lawyer must be implemented in Spanish law, including in respect of terrorism cases. In that context it refers to the Basic Principles on the Role of Lawyers.
