The present report of the Special Rapporteur on the independence of judges and lawyers is submitted pursuant to Commission on Human Rights resolution 1998/35. The report provides a brief discussion on theoretical issues which the Special Rapporteur considers to be important for the development of an independent and impartial judiciary. It further describes standards and guidelines for judges and lawyers that have been adopted or are in the process of being adopted by various associations around the world. The report also contains a brief summary of judicial decisions asserting the importance of and the principle of judicial independence. The Special Rapporteur refers to the Basic Principles on the Role of Lawyers which provide general guidelines for Member States to apply in their domestic justice systems.
