The present report of Amnesty International highlights the idea that everyone – particularly judges – should help to fight torture and what judges can do to help stop torture, in particular when they hear cases in which allegations of torture are made. The paper cites rules against torture set out in international law and the safeguards required by law to help prevent torture. Amnesty states that minimum guarantees should be incorporated and that all legal systems should provide such guarantees. The paper also refers to provisions against torture in Chinese law and to China’s international obligations on this issue. According to Amnesty China should also abide by and implement the various standards endorsed by the member states of the United Nations, such as the Basic Principles on the Role of Lawyers.
