The present report, submitted in accordance with Human Rights Council resolution 17/2, addresses the need to consider and integrate a gender perspective in the criminal justice system as a fundamental step towards allowing equal access to justice for women and men and in respect of the role to be played by judges and lawyers. The Special Rapporteur claims that, while worldwide quotas have caused a large increase in female representation in the legislature, States seem to have bypassed the opportunity to apply a similar gender analysis to the judicial branch. States, then, have to undertake measures to ensure that women have the same right as men to be judges, advocates or other officers of the court, thereby referring to Basic principle number 10. The Special Rapporteur firthermore addresses principle 9, by stating that The Basic Principles on the Role of Lawyers provide that Governments must ensure that lawyers have appropriate education and training, so as to be able to advise and protect the rights of their clients and uphold the cause of justice.
