The present document provides Amnesty International’s preliminary observations on the right to liberty and security of person.  This follows the Human Rights Committee’s drafting preparations for a new General Comment on article 9 of the International Covenant on Civil and Political Rights (ICCPR). Providing supplemental authority for the Committee, the present report draws on key aspects of the right to liberty and security of person including unlawful and arbitrary deprivation of liberty, police custody and detention pending trial, state of emergency, non-refoulement, extra-territorial application and horizontal effect.  Reference is made to the Basic Principles on the role of lawyers and specifically to the principles; access to lawyers and legal services, special safeguards in criminal justice matters and the functioning of lawyers.
