The present report presents findings of the Special Rapporteur on the independence of judges and lawyers official visit to Turkey from 10 to 14 October 2011. The report examines the wide-ranging reforms in Turkey, including at the constitutional level. In particular, reference is made to the role of public prosecutors in the administration of courts; the position and functions of the Minister of Justice within the High Council of Judges and Prosecutors; the need for separation between the careers of judges and prosecutors; the excessively close relationship between judges and prosecutors; the appointment, transfer and rotation system for judges and prosecutors; the mindset of judges and prosecutors; and the issue of women in the administration of justice. The report also focuses on the lawyers’ profession and examines the challenges encountered in the performance of their duties. The Special Rapporteur also makes recommendations concerning the requirements for admission to the Bar. The report draws attention to the Basic Principles on the Role of Lawyers and concludes with remarks in respect of capacity-building and legal human rights training for judges, prosecutors and lawyers.
