The present document of the International Commission of Jurists (ICJ) concerns the appeal of Leyla Zana, Selim Sadak, Hatip Dicle and Orhan Dogan, all Kurdish former parliamentary deputies, who were heard before the 9th Penal Chamber of the Court of Cassation, Ankara on 8 July 2004.The ICJ believes that defects emerged regarding the principles of equality of arms between the prosecution and the defence and the independence and impartiality of the tribunal.In summary, the ICJ/CIJL is concerned that a fair trial was undermined by the layout of the Court and the positioning of the Public Prosecutor next to the panel of judges. The ICJ states that relevant persuasive non-treaty standards include the Basic Principles on the Role of Lawyers.
