This report of Human Rights Watch (HRW) is based largely on interviews with recently released ISA detainees, family members of detainees, lawyers, and aid providers, as well as affidavits written by detainees and smuggled out of Kamunting, Malaysia. The report documents violations of the rights of alleged militants held under the Interal Security Act since August 2001. HRW states that the Basic Principles on the Role of Lawyers guarantee the right to counsel, and further specify that access to an attorney should happen as soon as is practicable after an arrest, “and in any case not later than fortyeight hours from the time of arrest or detention.” The right to confidential consultation and adequate time and facilities for consultation is also stressed.
