This report focuses on components of the national justice system of the Democratic Republic of the Congo (DRC) that are relevant to the investigation and prosecution of crimes under international law. The primary components are currently military courts and tribunals that have exclusive jurisdiction genocide, crimes against humanity and war crimes. However, the civilian criminal system is also considered. The exclusive jurisdiction of Congolese military courts over genocide, crimes against humanity and war crimes may be transferred to the civilian courts, as foreseen in the draft bill on the implementation of the ICC Statute. Amnesty International refers to the Basic Principles on the Role of Lawyers as an international standard with regard to the right to a fair trial.
