This article states the need of an independent Bar Association and examines the need for recognition of an independent Bar Association for the International Criminal Court. When the UN General Assembly created the Preparatory Committee on the establishment of an International Criminal Court,3 the seeds were planted not only for the creation of the International Criminal Court (ICC), but also for an independent association of national and regional bar associations and individual Counsel who would be appearing before the Court.
The author states that a self-governing an indepentent Bar Association is essential to a fair and indepent judicial system, as stated in the Basic Principles on the role of Lawyers. Consistent with the Basic Principles would be to recognize an independent representative body of counsel and legal association in the International Criminal Bar.
